The jury came back after nearly 38 hours of deliberations with a note that said “with a heavy heart” we are unable to come to a unanimous decision. After protest from the defense, Judge Sullivan said he had no choice but to declare a mistrial. But that didn’t stop Kevin Reddington who asked to appeal to a Supreme Court Justice to issue an emergency stay on the ruling, and shockingly, Judge Sullivan gave him one hour.

**BREAKING** Killer Mom Trial: Judge Gives Defense 1 Hour Before He Declares MISTRIAL

Before jurors began deliberating again this morning, things got heated once again between Lindsay Clancy’s attorney Kevin Reddington and Judge Sullivan. Reddington wanted the holdout juror to be questioned in open court, but the judge ultimately denied his request, saying there was no indication the juror has refused to deliberate or follow the law. Reddington then accused the judge of softly, glossing over his instructions to the jury, and that’s when Sullivan fired back, defending himself. The judge ultimately gave new, slightly more forceful instructions to jurors before sending them back to deliberations.

It’s anyone’s guess what may happen when court resumes at 9am in the triple murder trial of Lindsay Clancy. We heard from Clancy’s attorney, Kevin Reddington, that the judge will first hold an inquiry into the juror identified for refusing to follow the judge’s instructions on reasonable doubt. Depending on how that goes, jurors are then expected to resume deliberations for the seventh day, up against the timeline of a holiday weekend.

After 36 hours of trying to reach a verdict, the jury in the Lindsay Clancy trial will return on Friday for their seventh day of deliberations. But we just heard from defense attorney Kevin Reddington who told reporters there will first be an inquiry into the juror who reportedly refused to follow the judge’s instructions on reasonable doubt. Reddington hope that inquiry will be in open court, after his motion to remove the juror was denied this afternoon.

A dramatic turn of events in the Lindsay Clancy triple murder trial. There was a heated sidebar between the attorneys, the judge and Lindsay Clancy after the jury sent a note saying one juror has refused to follow the judge’s instructions on reasonable doubt. The judge called in each juror, one by one, asked them a question and then read aloud instructions for evaluating reasonable doubt. That wasn’t enough for defense attorney Kevin Reddington who filed a motion to have that one juror removed. The judge denied his motion and sent the jury back to deliberate.

The problem we so quickly realized, both verdicts have justifiable and verifiable evidence to reasonably back up each outcome.

The 12 jurors for the Lindsay Clancy triple murder trial are headed back to deliberations this morning, after trying to reach a verdict for nearly 30 hours over the past five days. The jury began deliberating LAST Thursday, and now, a full week later they continue after the judge issued a “Tuey Rodriguez” charge Wednesday afternoon, urging the group to reconsider their positions to try and find consensus. Clancy’s defense attorney Kevin Reddington says he’s ready to retry the case as soon as next week if a mistrial is declared, but acknowledged that regardless of the outcome, this case is a tragedy, reminding reporters that jurors have been through a very traumatic event.
