Chief Justice Roberts improperly relied on English common law as a basis for birthright citizenship, despite the framers using it only as a guide and rejecting elements that conflicted with the U.S. system. The 14th Amendment and the preceding Civil Rights Act of 1866 were narrowly intended to grant full citizenship rights to freed Black slaves and their children amid post-Civil War resistance—not to address immigration or confer citizenship on children of illegal aliens. The opinion wrongly equates "jurisdiction" with mere physical presence, leading to illogical results like automatic citizenship for babies of illegal immigrants (who retain foreign allegiance) while creating unaddressed exceptions for diplomats, revealing a result-oriented, activist approach that rewrites history. On Thursday’s Mark Levin Show, what made the Declaration of Independence remarkable was that it was unprecedented in human history. The Declaration serves as the foundational basis for the nation and its Constitution, celebrating America's purpose. Critics like Presidents Obama and Woodrow Wilson have rejected or downplayed its first part on the Creator and principles, focusing instead on the list of grievances against the king to advance new ideologies; however, President Coolidge defended these enduring, universal ideas from Aristotle and Locke as perpetual, not to be dismissed. The Declaration's concise statement of American identity is incompatible with Marxism, Islamism, and fascism. Also, President Reagan was a great admirer and friend of Milton Friedman. He often sought his input on economic policies. During Reagan's presidency, there was massive economic growth, and he won two historic landslide elections, popular vote and electoral college, like no Republican before or since. Alexander Hamilton would grow increasingly supportive of a powerful central government. He would argue with Thomas Jefferson and James Madison on their approaches to government during the Washington administration and beyond. Hamilton argued for implied powers under the Constitution, which infuriated Jefferson and Madison. Hamilton claimed the necessary and proper clause was essentially a ticket to significantly expanding federal action. Later, Americanism and capitalism are philosophies enabling individual decision-making under the Declaration and Constitution, whereas ideologies are fanatical beliefs imposed society-wide regardless of consequences. Communism is defective and anti-human, misreading human nature by suppressing free will, reason, debate, and academic freedom in favor of brainwashing, conformity, and central control, as seen in places like Cuba, Nicaragua, North Korea, and China, and similarly with Islamists. Nationalists, populists, and Marxists attack the American experiment, economic system, and culture through emotion, slogans of equality, and activist government, showing overlaps reminiscent of 1930s fascists and communists.

6/30/26 - Supreme Court's Birthright Citizenship Ruling: The REAL Problem Nobody's Talking About

On Monday’s Mark Levin Show, the American Marxism movement hates American institutions and is out to destroy America. And they have an ally: Islamism. Both ideas have been forced upon us by the Democratic Party. They seek to undermine our Constitution, our Judeo-Christian belief system, the nuclear family, our schools and universities. Despite their outward ideological differences, they share one goal: destroy the West. How? With immigration and open borders and using our constitutional protections against us. And there's a third problem: the Woke Reich neo-fascists, who are antisemitic and anti-Christian. The result is more young people who have been brainwashed to hate this country. We need to realize that we are under attack. Later, a recent 5-4 Supreme Court ruling that upheld states' post-election day ballot counting for federal offices undermines the Constitution. This weakens fraud detection, as the president is right that mail-in voting should be limited to those who are disabled, sick, or out of town—not universal. In states like California, ballots are sent to outdated addresses, and since such states are Democratic strongholds, pressure is ineffective, yet these practices improperly affect federal elections. Also, experience shows the Iranian regime lies, cheats, adheres to no agreements, and seeks to destroy all individuals, groups, or nations not complying with its 7th-century political-religious ideology through catastrophic worldwide war involving slaughter, torture, and rape until total submission. Unlike faiths that reformed, Islamists have not. Meanwhile, Zohran Mamdani is focused on de-populating NYC of as many Jews as possible and turning into a Dearborn, Michigan or Paterson, NJ. He’s making it unsafe and unlivable for Jews in the City. Finally, Director of the Ronald Reagan Institute Roger Zakheim calls in to discuss an Axios article that misleadingly headlined Republicans souring on Israel based on the Institute's survey. Zakheim clarified that Axios engaged in clickbait, as the survey and its own report actually showed the opposite: 75% of Republicans overall, and 80% of MAGA Republicans, believe U.S. security and prosperity are tied to Israel's security.

On Friday’s Mark Levin Show, WJNO’s Brian Mudd fills in for Mark. If you read the news, do you feel your intelligence has been insulted? There's an old saying: those who can't do, teach. When it comes to the media, those who don't know, report. It's been a great week for the U.S. tanker traffic which has almost returned to normal pre-war levels, the price of oil has returned to normal for summer, and the Trump Administration has brokered an agreement between the U.S., Israel and Lebanon. Yet according to the media, the world is terrible. There may be two sides to every story, but there's only one side to facts. So if you think your intelligence has been insulted, you're right. Then, the Senate still can't get its act together and pass the SAVE America Act. Why is this important? Voter fraud has always existed. In Florida, the DOJ announced three arrests of non-citizens for voting in federal elections. Three cases in one week in a red state. How much worse is voter fraud in sanctuary states and cities? With the midterm elections coming up, and voter ID being a 90/10 issue with Americans, we still can't get the SAVE America Act across the finish line. Also, the election integrity project ranks election integrity all over the world. The U.S. scores 54. California's score is 35, lower than Haiti at 37. Between mail-in voting, ballot harvesting and other shenanigans, no wonder they're still counting votes in the CA primary. When you have blue states like CA bent on lowering election standards, federal minimum requirements, like voter ID, must come into play. Finally, the extent of the Democrat's long game is underappreciated. Starting with Saul Alinsky in the 1960s, then with the elections of Bernie Sanders in 1990, Barack Obama in 2004, The Squad in 2018, and Zohran Mamdani in 2025, the Democrats have moved further and further to the hard left. Trump is right: the midterm elections have never been more important.

6/26/26 - Oil Prices Normal, Tanker Traffic Restored, Yet Media Says World is Terrible | Brian Mudd Fills In

On Thursday’s Mark Levin Show, WJNO’s Brian Mudd fills in for Mark. Two major SCOTUS decisions on border security today. First, the Court ruled 6-3 that you have to be in the U.S. to make an asylum claim. In the other, the Court again ruled 6-3 that the Trump Administration can revoke temporary protection status from Syrian and Haitian migrants. The three liberal justices tried to argue that you don't actually have to be "in" the U.S. to make an asylum claim, and "temporary" actually means indefinitely. Does the rule of law mean anything to these justices? Could it be that they are radical progressives who don't know right from wrong and want to abolish Constitutional law? Then, most people today don't appreciate the historically great leadership we have or how much has been accomplished in a short time. Since January, he has split off Venezuela from China and disabled the Iranian terror regime and their ability to build nuclear weapons and start World War III. The focus has been on affordability. Consider that 100 years ago, during the Roaring Twenties, people thought things were great. Now, average life expectancy and household income are higher, we have things like indoor plumbing, electricity and A/C, and China has been kneecapped thanks to Trump cutting off their supply of oil. We need to appreciate just how good we have it. Finally, there is a new Cold War...and we're losing. Whoever wins the AI race will be the new superpower. China has excess data center capacity, yet the only thing Americans are more united on in their opposition to data centers is voter ID. China just announced they've built the world's most powerful supercomputer. It's simple: if China out-computes us, they defeat us.

Later, President Trump selected Kash Patel to combat waste, fraud, and abuse, is proving to be an excellent choice as evidenced by a record-setting $6.5 billion healthcare fraud crackdown charging around 450 defendants, primarily in Medicaid and hospice schemes. Officials emphasized unprecedented state-federal cooperation across 45 states and attorneys general, building complete case files for swift law enforcement action—the first such unified effort in modern history. Afterward ,a Biden-appointed federal judge issued a 75-page opinion shutting down the Trump administration's modified SAVE system database, created via executive order to verify citizenship or immigration status of registered voters through DHS and SSA records. This activist decision promotes lawlessness and voter fraud by blocking checks on non-citizens, dead people, and illegal immigrants, especially ahead of midterms. The same judge also blocked an FTC antitrust probe into Media Matters and barred deportation of unaccompanied migrant minors for family reunification abroad. Meanwhile, Senator Mike Lee advances the SAVE America Act, requiring government-issued ID to vote—supported by over 80% of Americans across parties to make voting easy but cheating hard—though four anti-Trump Republicans hinder it in the Senate, where Trump is pushing for passage.

6/23/26 - Exposing the Radical Agenda of James Talarico | Ben Ferguson Fills In

On Tuesday’s Mark Levin Show, heavily armed TikTokers, motivated by hatred of Trump, billionaires, Israel, and Jeffrey Epstein-related conspiracies, plotted a multi-phase attack on the UFC Freedom 250 White House event using explosive drones on the South Lawn followed by sniper teams to massacre fleeing attendees. The FBI foiled the plot by infiltrating the chats after a suspect's mother alerted police over his firearm purchases and radicalization. These Woke Reich conspiracy promoters are fueling such violence, as the Woke Reich overlaps significantly with Marxist-Islamist left ideologies. Also, Israel will endure and cannot be expected to stand idle against Hezbollah attacks (fired at Iran's behest, causing deaths and injuries) while being criticized for collateral damage in the same manner as during the Gaza conflict, where experts confirmed no genocide occurred as enemies hid among civilians. Meanwhile, the suggestion of Syria replacing Israeli efforts against Hezbollah should be rejected. Later, despite joint tax filings, average annual income of $1.4 million, $450,000 in taxes, and significant expenses like domestic workers, private school, and mortgages, questions remain about funding sources from Gavin Newsom and his wife. Yet, Newsom complains that the investigation into this is political. This defense is so hypocritical – Democrats ignored the political actions against Trump. Finally, Ambassador Michael Leiter calls in and discusses the strong alliance between Prime Minister Netanyahu and President Trump, noting frequent phone calls, and deep mutual respect and friendship despite occasional civil disagreements. Media narratives of an acrimonious relationship are misleading, as they cherry-pick isolated tense moments. Leiter clarified that there is no rift between the two and acknowledged legitimate differences over a yet-unseen Iran deal. Israel stands as America's closest ally, making any wedge between the two nations impossible.
